4. HOW WE USE INFORMATION
We use information for the following purposes:
- Saela collects and uses personal, technical, and health-related information solely for the purposes described in this Privacy Policy and in accordance with applicable law. The information we collect enables us to provide, maintain, enhance, and secure the App, as well as to communicate with users and comply with legal obligations. We do not use Sensitive Health Data for advertising or sell it to third parties. All processing activities are performed on the lawful basis of user consent, contractual necessity, or legitimate business interest.
- We use your information to provide and maintain the App by creating and managing user accounts, authenticating users through one-time passwords (OTP), Apple, Google, or device biometric verification, and ensuring secure access to your account. This includes delivering the App’s core features such as menstrual cycle tracking, predictive analytics, adaptive recommendations, and personalized insights. We also use this information to process and verify subscription payments through the App Stores and manage affiliate transactions via Stripe where applicable.
- We personalize and improve your experience by analyzing your data inputs, preferences, and engagement trends to generate accurate insights and enhance the App’s overall functionality. This includes refining our predictive models and algorithms—both on-device and through secure servers—to provide more accurate and relevant wellness recommendations. We also conduct research, analytics, and product development using de-identified or aggregated information to ensure continuous improvement of the App and Services while maintaining user privacy.
- Where you choose to enable integrations such as Apple HealthKit or Google Fit, we will only sync data categories that you explicitly authorize. These integrations are used strictly to enhance your personalized experience and not for any form of targeted marketing or resale. All such integrations operate under your active consent and can be disabled at any time through your device settings.
- We communicate with you using the contact details you provide for account verification, service updates, technical notices, and security alerts. We may also send you optional communications such as wellness tips, feature updates, and user surveys. You may opt out of non-essential communications at any time without affecting your access to core App features.
- We use your information for safety, security, and legal compliance by monitoring usage patterns to detect, investigate, and prevent fraud, misuse, or security threats. We may also use information to enforce our Terms of Service, protect our intellectual property, and comply with applicable legal or regulatory requirements, including responses to lawful subpoenas or government requests.
Saela does not use Apple HealthKit or Google Fit data for advertising and does not sell or share any Sensitive Health Data for marketing or commercial gain. All processing activities involving health data are strictly limited to delivering the App’s wellness and informational features, and Services.
5. AUTOMATED DECISION-MAKING AND ARTIFICIAL INTELLIGENCE (AI) MODEL USE
5.1. The App uses artificial intelligence (AI) and machine learning algorithms to analyze user inputs and provide wellness insights. These algorithms do not make decisions with legal or similarly significant effects on users. Insights are generated automatically for informational and educational purposes and are not medical determinations.
5.2. Saela may train, test, or refine its AI models using de-identified or aggregated datasets derived from user interactions, ensuring that no personally identifiable or health-identifiable data is used in model training without your explicit consent. For the sake of clarity, Saela’s model-training datasets contain only de-identified or aggregated data and cannot be reverse-engineered to reveal individual health records.
5.3. Future Research, Insights and Advertising. Saela may, in future product versions, display in-App advertisements or provide de-identified, aggregated health-trend data to third parties for research or statistical purposes. No personally identifiable (i.e. Personal Information) or health-identifiable data (i.e. Sensitive Health Data) will ever be disclosed for such purposes without obtaining your explicit, opt-in consent within the App. You will be able to manage or withdraw such consent at any time under the App’s privacy settings.
6. SENSITIVE HEALTH DATA AND CONSENT
6.1. Saela processes Sensitive Health Data, including menstrual, reproductive, hormonal, and related wellness information, only with your explicit and informed consent, and solely to deliver the App’s personalized tracking, analytics, and insight features. Such data may include information you voluntarily provide regarding your cycle, symptoms, moods, sleep, activities, and reproductive intentions. Saela treats all Sensitive Health Data as confidential and applies heightened security and access restrictions to ensure compliance with applicable data protection and consumer health privacy laws.
6.2. You may withdraw your consent to the processing of Sensitive Health Data at any time through the App’s privacy or account settings. Please note, however, that withdrawing consent may limit or disable certain features or functionality of the App that depend on this data. When consent is withdrawn, Saela will cease processing your Sensitive Health Data, except where continued processing is required by law, to protect the integrity of our systems, or for legitimate business purposes such as fraud prevention or record retention. Upon receiving a verified deletion request, we will permanently delete your Sensitive Health Data within thirty (30) calendar days unless legal or regulatory obligations require a longer retention period. Deletion will include all associated health entries, metadata, and analytical derivatives to the extent technically feasible.
6.3. Saela ensures that all Sensitive Health Data is processed transparently and securely, with encryption, strict access controls, and data minimization practices. We will never use Sensitive Health Data for advertising, profiling, or data monetization.
6.4. We do not infer or create new Sensitive Health Data categories through algorithmic analysis or automated decision-making beyond what you voluntarily provide or explicitly authorize. Automated insights (such as predictions and recommendations) are based on your inputs and are intended for informational purposes only.
6.5. Data Segregation and Device-Linked Architecture. Saela stores personally Personal Information and Sensitive Health Data on separate secure servers. These datasets are indexed only by randomized device-specific identifiers that Saela cannot reverse-link or re-associate. Only the user’s device retains the local key necessary to correlate Personal Information with Sensitive Health Data. As a result, Saela cannot identify or reconstruct a user’s Sensitive Health Data from server-side data alone, even in response to legal process, unless compelled by law and technically feasible.
6.6. Users may permanently delete all Personal Information and Sensitive Health Data through the in-App ‘One-Tap Delete’ function, which triggers immediate de-linking of device identifiers and irreversible deletion of associated records from active systems. Confirmed deletion requests propagate across system backups within ninety (90) days, consistent with Section 15 (Data Retention) of this Privacy Policy.
7. APPLE HEALTHKIT AND GOOGLE FIT
Saela integrates with Apple HealthKit and Google Fit to provide enhanced wellness and tracking features only if you choose to enable these integrations. We will only access, collect, or use data from these sources that you explicitly authorize within your device permissions. This may include metrics such as heart rate, activity levels, sleep duration, or step count, depending on your consent settings. We use this data exclusively to provide or improve the App’s wellness features, enhance your user experience, and generate personalized insights. We do not use Apple HealthKit or Google Fit data for advertising, data profiling, or resale, and we do not share such data with third parties except (i) as necessary to operate or improve the App’s health features, (ii) with your explicit consent, or (iii) where required by applicable law. All data exchanges between Saela and these platforms are encrypted and performed in accordance with the privacy and security requirements set forth by Apple and Google.
Saela fully complies with Apple’s HealthKit Developer Guidelines and Google’s Fit Platform Developer Policies. Users retain full control over the scope and duration of any connected integration and may revoke permissions at any time through their device settings.
8. FUTURE HORMONE BIOSENSOR INTEGRATIONS
In future versions of the App, users may have the option to connect a hormone biosensor or similar wearable device for advanced cycle tracking and hormonal pattern analysis. Should you choose to enable this feature, Saela will collect biosensor readings (e.g., hormone levels, temperature, or related physiological metrics) and device metadata for the purpose of delivering deeper, data-driven personalization and enhanced accuracy of wellness insights.
Before activating any biosensor integration, Saela will provide a clear and transparent consent flow describing the categories of data to be collected, the purposes of processing, data retention periods, and whether any third-party service providers are involved in processing. Your explicit opt-in consent will be required before any biosensor data is accessed or transmitted. You may withdraw this consent at any time under the App’s settings tab, after which biosensor data collection will stop, and related data will be deleted within thirty (30) days unless retention is required by law.
Saela will ensure that any future biosensor integrations adhere to applicable U.S. and international health data protection regulations, maintain strong encryption standards, and limit data access strictly to authorized personnel and systems. We will never share or sell biosensor data for advertising or unrelated commercial purposes.
9. PAYMENTS AND SUBSCRIPTIONS
Saela offers both free and premium subscription-based Services. Payments for premium subscriptions are processed through the Apple App Store or Google Play Store, depending on your device and account preferences. We only receive limited transactional metadata, such as your subscription status and payment confirmation, from these platforms. We do not receive or store your card information/details, which is processed securely by these third-party platforms in accordance with their own privacy and data security policies.
All payments and refunds are handled by the Apple App Store or Google Play Store; Saela does not collect or store your card details.
If your subscription expires, is cancelled, or encounters a payment issue, we may contact you to assist in resolving the matter or to inform you of service interruptions. All payment data shared with us is limited, secured, and used exclusively for subscription verification, fraud prevention, and customer support purposes.
10. PROHIBITED USES AND HEALTH DATA EXPORT LIMITS
You may not misuse, reverse engineer, modify, copy, or resell the App, its source code, content, or any data derived from it. Any unauthorized use of the App’s data, algorithms, or analytics, including automated extraction or scraping of data is strictly prohibited. Health-related information collected or generated through the App is for your personal use only and may not be exported, copied, or repurposed for commercial, research, or analytical purposes without our prior written consent.
While this Privacy Policy does not restrict your statutory rights to access or obtain a copy of your Personal Information, we expressly prohibit any automated or programmatic export, replication, or redistribution of Sensitive Health Data for third-party use. You are also prohibited from using the App to develop or train external software, AI models, or data analytics tools. Any violation of these restrictions may result in suspension or termination of access and potential legal action.
11. MEDICAL AND WELLNESS DISCLAIMER
Saela provides wellness and informational content only. Saela does not provide medical advice, diagnosis, or treatment. You must consult a qualified healthcare professional for any medical concerns. Do not ignore professional medical advice or delay seeking care because of information or insights provided by the App and Services.
Saela does not provide medical or healthcare services, and we are not a licensed medical provider. The information generated by the App should never be interpreted as medical advice or medical diagnosis. Always seek the advice of a qualified healthcare professional before making decisions regarding your health, fertility, contraception, or medical treatment.
12. WHEN WE SHARE INFORMATION
Saela shares information only where necessary and in accordance with this Privacy Policy. We do not sell Personal Information or disclose Sensitive Health Data for advertising or profiling purposes. Information may be shared in the following limited situations:
- We share information with service providers and processors that assist us with essential operations, including cloud hosting, analytics, crash diagnostics, communications, customer support, content moderation, and security monitoring. These service providers are contractually required to safeguard the data and may use it only to perform their assigned tasks on our behalf.
- We share information with payment and platform providers, including Apple App Store, Google Play Store, and Stripe, for subscription management, payment processing, and authentication. In cases where Apple or Google single sign-on (SSO) or device-level authentication is used, relevant identifiers are shared solely for secure login and account verification.
- We may share information with our affiliates and in the context of corporate transactions, such as mergers, acquisitions, financing, or dissolution. Any transfer of Personal Information in such cases will remain subject to equivalent data protection and confidentiality obligations.
- We may disclose information to comply with applicable laws, court orders, or governmental requests, or to protect the rights, property, or safety of Saela, its users, or others. Such disclosures are limited to what is legally required or necessary for enforcing our Terms of Service or responding to regulatory authorities.
13. THIRD PARTY PROCESSORS AND INTERNATIONAL COMPLIANCE
Saela ensures that all third-party service providers, sub-processors, and contractors handling Personal Information are bound by written data processing agreements that include confidentiality, security, and non-disclosure obligations consistent with this Privacy Policy.
For any cross-border processing, Saela requires that third parties maintain equivalent or higher data protection standards and implement contractual safeguards consistent with recognized international data transfer frameworks (e.g., Standard Contractual Clauses).
A list of sub-processors handling Personal Information may be made available upon written request to contact@saelasync.com.
14. COOKIES, MOBILE IDENTIFIERS, AND SOFTWARE DEVELOPMENT KITS
Saela uses cookies, mobile identifiers, and Software Development Kits (“SDKs”) to ensure the App and related Services function properly, improve user experience, and maintain security and reliability. Cookies are small data files stored on your device that help us remember your preferences, manage session authentication, and provide customized features such as language settings and display options. Mobile identifiers and SDKs operate similarly by collecting limited technical information to enable analytics, diagnostics, crash reporting, and system optimization.
These technologies allow us to measure App performance, understand usage patterns, detect technical issues, and prevent fraud or misuse. They also help us maintain session continuity, manage subscription processes, and remember your preferences between sessions. Some SDKs, provided by trusted third parties, assist in analytics and push notifications. These partners are contractually obligated to use data only for providing services to us and not for independent advertising purposes.
You can manage or disable cookies and tracking technologies through your device or browser settings; however, disabling certain cookies may limit functionality or performance of the App. Saela does not use cookies, SDKs, or mobile identifiers to collect or share Sensitive Health Data for targeted advertising. All data processed through these technologies is handled in accordance with this Privacy Policy and applicable U.S. and state data protection laws.
15. DATA RETENTION
We retain Personal Information for as long as needed to provide the App, comply with legal obligations, resolve disputes, enforce agreements, and for legitimate business needs.
Once Personal Information is no longer necessary for the purposes described, Saela securely deletes or de-identifies it. De-identified or aggregated data may be retained indefinitely for analytics, AI training, or research in a non-identifiable format. When retention is required by law or for legal defense, data will be archived under restricted access and encrypted storage.
Saela maintains system backups to ensure reliability and continuity. Deleted user data may remain in encrypted backups for up to ninety (90) days before being permanently erased, unless a longer period is required for legal compliance or system recovery purposes.
16. SECURITY
Saela employs a comprehensive security framework to safeguard Personal Information and Sensitive Health Data from unauthorized access, alteration, disclosure, or destruction. We utilize administrative, technical, and physical security measures, including encryption of data both in transit and at rest, multi-layer authentication, secure cloud infrastructure, and continuous system monitoring. Access to user information is restricted to authorized personnel who are bound by confidentiality obligations.
Despite our robust efforts, no digital system is entirely immune to security risks. If a data breach or unauthorized access incident occurs, Saela will take immediate steps to mitigate the impact, investigate the root cause, and comply with all notification obligations under applicable law. Affected users will be promptly informed of any breach that poses a material risk to their privacy or data security.
17. DATA BREACH NOTIFICATION AND MITIGATION
In the event of a security incident involving Personal Information or Sensitive Health Data, Saela will promptly investigate, mitigate harm, and notify affected users and relevant regulators where required by law. Notification will include a summary of the nature of the breach, categories of data affected, remedial steps taken, and available protective measures.
Saela maintains a dedicated incident response plan, conducts periodic vulnerability assessments, and performs regular security audits to reduce the likelihood and impact of such events.
18. US STATE PRIVACY DISCLOSURES
Depending on your U.S. state of residence (including but not limited to California, Colorado, Connecticut, Utah, Virginia, Oregon, and Texas), you may have specific legal rights under applicable data protection laws. These may include the right to know or access your Personal Information; to request correction or deletion; to obtain a portable copy of your information; and to opt out of the sale or sharing of Personal Information for cross-context behavioral advertising. This information may be disclosed only to our service providers, platform providers, and as required by law. We obtain your explicit consent before collecting or using consumer health data for these stated purposes. Saela does not use or permit the use of geofencing technologies to target health facilities, clinics, or reproductive health centers in violation of applicable law.
